BHI Turtle Time Vacations, LLC Rental Agreement. We are a Property Management Company that partner with property owners to attract guests for rental services and make sure the finest details of the vacation home is handled professionally. Please read your Vacation Rental Agreement carefully before you begin your vacation. Any monies received by BHI Turtle Time Vacations, LLC for occupancy of Vacation Property indicates the acceptance of the terms of our Vacation Rental Agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.

GUEST REQUIREMENTS: For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the Guest. All other persons involved with the rental are considered to be the Guest’s invitees, and all discussion regarding reservation, cancelation, and damage policies will be discussed with the Guest, not the Guest’s invitees. The Guest understands that BHI Turtle Time Vacations, LLC rents to responsible adults over the age of 25 ONLY.

RESERVATIONS: There are several ways you can reserve a property. You can call our office during hours of operation and speak to a reservation specialist, or you may book directly from the website 24 hours a day. In order to complete the booking process, a 50% deposit is required when making a reservation. When reserving a property on our website via ONLINE BOOKING, you will be required to give a credit card number over our secured website. After a reservation is made and payment is received, a Confirmation Lease Agreement is sent via email. The Confirmation Lease Agreement must be signed and returned to our office via electronic signature, email, or regular mail within 7 days of reservation. If your reservation date is less than 2 weeks from your arrival date, your signed confirmation lease agreement must be overnighted. NOTE: guests without signed contracts will not be allowed to check in.

METHOD OF PAYMENT: Personal checks will be accepted up until forty five (45) days prior to arrival. For reservations within forty five (45) days of arrival, the only accepted forms of payment are: Cashier’s Check, Certified Check, Money Order, Cash, Visa, MasterCard, Discover and American Express. THESE PAYMENTS MUST BE RECEIVED BY BHI TURTLE TIME VACATIONS WITHIN 48 HOURS IN ORDER TO CONFIRM YOUR RESERVATION.

RETURNED CHECKS Any check returned for non-sufficient funds or stopped payment will not be re-submitted. A letter will be sent to you indicating full payment required within ten (10) days by money order, cashier’s check, certified check, or credit card payment. Additionally, a fee of $55.00 will be charged for any returned check.

DOWN PAYMENT/ PAYMENT: A reservation can be made with a 50% deposit paid by credit card using USD currency when the reservation is made. Full payment is charged 45 days prior to scheduled arrival date.

If a check (payable to BHI Turtle Time Vacations, LLC) or money order is not received by the due date, the balance will be charged to your credit card. The credit card must have an expiration date that extends beyond your stay. If a reservation is made less than 45 days prior to arrival, full payment is due when the reservation is made. A $55.00 service charge will be incurred for any returned checks.

BALANCE PAYMENT: If no other payment is received 45 days prior to arrival, we will automatically charge the balance on the credit card on file. Balance is due no later than 45 days prior to your arrival date. The balance will be charged on the same credit card used for the initial payment unless the guest provides an updated card.

MINIMUM STAY & OCCUPANCY REQUIREMENTS: Most of our properties are rented Friday to Friday, Saturday to Saturday or Sunday to Sunday, with a seven night minimum stay for June, July, and August, AND some holiday periods during the off season. Most properties require a three or four night minimum stay (depending on size and location) during the off season; however, we do have some 2 night stays available during the off season.

Due to the nature of our rental properties and the contracts we have with our homeowners, BHI Turtle Time Vacations does NOT rent to persons under the age of 25 years old and does NOT cater to groups (i.e., graduation parties, sororities, fraternities, spring break groups, etc.). Our rentals are for family vacations. Misrepresentation will result in immediate eviction from the property and forfeiture of all monies paid, including security deposit. Subletting is strictly prohibited and will result in immediate eviction from the property and forfeiture of all monies paid, including security deposit.

DAMAGE POLICY: We keep a credit card on file. We will not charge anything to your account without notifying you first. Damage Insurance is included in all reservations (see more below)

ACCIDENTAL DAMAGE PROTECTION – THE DAMAGE WAIVER for the Property, as set forth in the Vacation Rental Terms and Conditions, includes provisions for Accidental Damage Protection (“ADP”). ADP is provided by BHI Turtle Time Vacations, LLC through Red Sky Insurance, and is included in your reservation in lieu of a security deposit. The Damage Waiver is designed to cover unintentional damages to the rental unit that occur during tenancy. Subject to the provisions of the policy the maximum benefit is $3,000.00. If, during tenancy at one of our rental properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to the maximum benefit.

Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period.

Tenant understands and agrees that any damage to the Property, its furniture, furnishings, appliances, vehicles, or equipment, or any missing property, must be reported to BHI Turtle Time Vacations, LLC, immediately, but in no event later than twenty-four (24) hours after Tenant check-out. Failure to timely report damage or missing property may result in denial of coverage under the ADP and Tenant shall be personally liable for the full cost of repair or replacement. If unreported damage or missing property is discovered at or immediately after Tenant’s departure from the Property, or if a claim for damage or missing property under the ADP is denied for any reason, or if the cost of repair or replacement of damage or missing property exceeds the maximum benefit under said ADP, then in any of those cases, Tenant will be responsible for the difference and BHI Turtle Time Vacations, LLC, shall be entitled to charge Tenant’s credit card account for said additional charges as well as actual damages suffered as a result of Tenant’s breach. Note: The ADP does not cover theft or purposeful and malicious damages. Such will be the full responsibility of the tenant.

SECURITY DEPOSIT– Security Deposit may be required per property specific unless hereinafter waived. Tenant is responsible for any damages to Owner’s Property during the tenancy and the Security Deposit may be used by the Owner for actual property damage, cable TV charges, long distance phone calls, and damage to furnishings, house hold items, carpet, and flooring caused by Tenant as well as those allowed by NCGS 42-51. Tenant is responsible for items discovered missing from Property following the tenancy. Tenant must check the Property upon arrival and report all damages found or items that are obviously missing. Failure to report any damaged items prior to check-out shall result in the full or partial loss of the Security Deposit. There will be an accounting of the Security Deposit within 45 days of Tenant’s departure. At Agent’s discretion an additional Security Deposit may be required. Refusal to pay any Security Deposit requested by Agent shall constitute a material breach by Tenant and shall result in refusal of occupancy, termination of this agreement, or eviction without refund. North Carolina law allows Security Deposits to be up to twice the amount of the weekly rental rate. Tenant shall reimburse Owner for all damages to Owner’s property caused by Tenant that is not paid by the Security Deposit. Tenant shall also be responsible to Owner for attorney fees and other costs ,as allowed by law, in order to collect such damages.

ADMINISTRATION FEE: A non-refundable processing applies to each reservation.

TAXES- N.C. State law requires that BHI Turtle Time Vacations, LLC,  charge 6.75% state sales tax on the rental of all vacation homes. The Village of Bald Head Island requires that BHI Turtle Time Vacations, LLC, charge a 6% Village Occupancy tax on the rental of all vacation homes.

CANCELLATIONS: We have a NO REFUNDS ARE GIVEN and ALL RESERVATIONS ARE FINAL UPON BOOKING. This will result in 100% loss of all payments. This loss can be avoided by purchasing Travel Protection Insurance. You can purchase independently through Red Sky Insurance Sun Trip Preserver http://www.trippreserver.com/. Below is more information on Travel Protection Insurance.

There will be NO REFUNDS OR CREDITS FOR HURRICANE EVACUATIONS. Whether you own property, run a business, or rent property, the threat of a hurricane is always present and we all assume this risk. Therefore, we suggest you consider Travel Protection Insurance to secure your vacation investment. 

REFUNDS: Subject to the other provisions of this Vacation Rental Agreement and the requirements of the Vacation Rental Act Tenant’s maximum compensation recoverable is the full refund of all funds previously received from Tenant subject to the following:  A refund shall be reduced by fees paid to third parties for the benefit of Tenant; A refund shall be reduced in a pro-rated amount if Tenant has occupied Property for a portion of the term; A refund will not be available if Tenant accepts a relocation and agrees to pay any difference in rental rate, applicable taxes and expenses incurred because the property is unavailable; No refunds will be available if Tenant is evicted; There will be no refund of any kind due to mechanical failure of non-essential items such as air conditioner, TV, Internet, dishwasher, washer/dryer, or other luxury items. However, we promise to make every effort to have such items repaired as quickly as possible. You can be assured that, with BHI Turtle Time Vacations, your vacation will be as trouble-free as possible. Due to constant growth in our community, we cannot refund any money due to interruptions from neighboring properties that may be under construction.

TRAVEL PROTECTION INSURANCE: BHI Turtle Time Vacations has contracted with Red Sky Travel Insurance in order to offer Travel Protection Insurance to our guests. Your Lease Agreement will include this optional coverage, which will cost only 6.95% of your total rental amount. This insurance coverage not only protects your vacation investment against hurricanes but also covers other unforeseen circumstances which could cause cancellation of your trip and forfeiture of payments. It even covers some circumstances which affect other members of your group who would be vacationing with you. Following is a summary of the features of this insurance coverage.

INSURANCE COVERAGE: TRIP CANCELLATION AND INTERRUPTION: Pays for nonrefundable payments and certain extra costs if your trip must be cancelled or interrupted for unforeseen injury, sickness or death. It also covers unforeseen circumstances such as severe weather, summons to jury duty or other covered events. This includes coverage for lost days of your vacation due to MANDATORY EVACUATION orders issued by Brunswick County officials.

TRAVEL DELAYS: Covers certain expenses if your trip is delayed 12 hours or more.

QUESTIONS/ANSWERS: How do I obtain coverage? You will be offered this coverage when you  make your reservation. Your Lease Agreement will include the fee for this coverage. Simply pay the amount indicated on your Lease with your initial deposit.  If you do not desire this protection, sign the lease where indicated to decline coverage..

When is my coverage effective? Your coverage begins when BHI Turtle Time Vacations receives your payment and signed Lease Agreement.

What do I receive indicating my coverage? Upon receipt of your payment. BHI Turtle Time Vacations will send you a pamphlet which describes your coverage in more detail. A master contract number will be assigned indicating verification of coverage.

Whom do I call with questions? Feel free to call Red Sky Travel Insurance directly at 866-889-7409. They have an excellent customer support staff who are prepared to answer all your questions.

How would I make a claim? Your Insurance coverage is administered through Red Sky. Simply call 866-889-7409 or visit their website at http://www.trippreserver.com/

FERRY AND TRAM RESERVATIONS- Tenants are required to secure reservations for use of the trams, which take guests and their luggage to/from rental properties. Tram seats fill up very quickly for the peak summer season and holidays, as tram seating capacity is far less than the capacity for the ferry. While selecting your departure ferry for the end of your stay, please remember that trams will arrive to pick you up from your rental home 30-45 minutes prior to your scheduled ferry time. Please note, there are currently no alternative methods of transportation available to and from ferry. Tenant is required to send BHI Turtle Time Vacations, LLC, a confirmation for booking on arrival and departure trams within 30 days of booking Property.

NOTE: TRAM SPACE IS LIMITED – PLEASE CALL 910.457.5006 AS SOON AS POSSIBLE TO MAKE YOUR RESERVATIONS TO AND FROM THE ISLAND WHEN BOOKING. BHI TURTLE TIME VACATIONS IS NOT RESPONSIBLE FOR GETTING YOU TO AND FROM YOUR RENTAL PROPERTY. CHECK OUT IS 10AM AND CHECK IN IS 4PM.

CLUB MEMBERSHIPS- Tenant understands and acknowledges that the lease of the Property hereunder does not include temporary membership privileges to the Bald Head Island Club or Shoals Club.

Club Memberships are property specific. Please confirm your property of choice includes a club membership(s). Should Tenant choose to purchase a temporary membership to the Bald Head Island Club separately, Tenant shall be allowed access to the facilities and recreational amenities of the private club. Tenants staying in a property with golf privileges may play golf in accordance with club rules and subject to club-regulated costs, with the purchase of a temporary club membership. Tenants staying in a property that does not offer golf privileges (“House” membership) may not play on the BHI golf course, but may enjoy all other club amenities, subject to any applicable club fees, with the purchase of a temporary club membership.

Some properties offer Shoals Club privileges. In such cases, Tenants may purchase a temporary Shoals Club membership at Tenant’s cost. Tenants who are not staying in a home offering Shoals Club privileges may not use the Shoals Club facilities.

GOLF CARTS- Electric vehicles (golf carts) are not toys, and their misuse can lead to serious adverse consequences. They are subject to all laws and ordinances applicable to operation of a motor vehicle on a public road, including the requirements that all operators must be at least sixteen (16) years of age, possess a valid driver’s license, and not be under the influence of alcohol or drugs. North Carolina traffic laws and ordinances are enforced by the Village of Bald Head Island and operators of electric vehicles are subject to and responsible for fines and parking tickets. Tenant should read and follow all instructions provided in the vehicle for golf cart operation, including the precautions suggested for the safety of drivers and passengers. Tenant shall comply with all applicable laws and ordinances, shall be liable for any fines or parking tickets, costs or charges, as well as damage or injuries, (including death) they or their guests or invitees cause while operating an electric vehicle, and shall indemnify and hold BHI Turtle Time Vacations, LLC, and Owner free and harmless from liability for same. Each home will have available at least one (1) golf cart for use. If the golf cart stops working, BHI Turtle Time Vacations, will attempt to have it repaired as soon as possible. If the golf cart cannot be repaired, BHI Turtle Time Vacations, LLC, will arrange to rent a replacement, subject to availability.

UPON ARRIVAL: Guest should carefully examine their rental unit. If there are concerns or issues with your rental property, please immediately contact our office (leave a message if there is no answer). No refunds or considerations are given unless we are notified of problems during your stay.

ARRIVAL TIME: Check in is at 4:00 pm.. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your scheduled check in time. Please remember trams book very quickly. Please make reservations prior to your arrival. It is recommended to make those arrangements at the time of booking your rental home. The earlier the better!

DEPARTURE TIME: Check out is at 10:00 am. Your prompt departure is appreciated so we can prepare the home for any incoming guests. If you have not arranged for a late check out, you may be charged $100.00 for each hour beyond 10:00 am you are still on property, at a minimum of one hour. If the home has not been vacated by 12:00 pm and cart returned to the home on charge, a fee equal to the rental rate of 2 days may be assessed.

EMERGENCIES/ MAINTENANCE: In the event of an issue gaining access to your rental or if there are problems with condition or functionality of your rental, please immediately contact the BHI Turtle Time Vacations, LLC office (please leave a voice message if necessary) at (919)538-3926. If it is after office hours (8am-4pm) we will make every effort to return your call as soon as possible. If we do not promptly return your call and it is an urgent situation, you may call or text our emergency line at (919) 900-0732 Otherwise, you will be contacted during normal business hours.

POWER/ WEATHER RELATED CANCELATION: BHI Turtle Time Vacations, LLC does NOT issue refunds due to acts of nature such as: weather, road conditions, snow conditions, hurricanes, floods, power outages or forest fires.

CHANGE IN NUMBER OF GUESTS/CONDUCT OF GUESTS: Guest(s) agrees that additional occupants are not permitted other than the number of occupants originally stated on the reservation. Unauthorized people at the rental at any time will result in a double charge for each additional guest or a maximum occupancy charge (whichever is more), and loss of any security deposit, in addition to any and all damage, disturbance, and cleaning charges. The rental is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions are made on an individual basis – please contact BHI Turtle Time Vacations, LLC for prior approval. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premises without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the vacation rental can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival.

CLEANING FEE(s): A non-refundable cleaning fee is required with all reservations. This fee is for our housekeepers who dust, vacuum, sanitize, clean linens and towels. Guest(s) are required to follow all check out procedures detailed in this agreement and leave the property in the same general and good habitable condition it was in when the Guest(s) arrived. Undue and/or unreasonable cleaning of the home shall be charged to the Guest’s/Cardholder’s credit card as an Additional Cleaning Charge at a rate of $100/hour, with a one hour minimum. This also applies to the property exterior, grounds, BBQs and golf carts.

CLEANING REQUIREMENTS: A starter supply of expendable supplies such as paper goods and dish soap are provided; please bring additional supplies if you feel this will not be adequate or you may purchase at the market on Bald Head Island. Housekeeping is not provided during your stay unless previously arranged. Failure to comply with pre-departure cleaning requirements resulting in excessive cleaning will be charged to your credit card at $100/hour, with a one-hour minimum:

1) Place used linens and towels in the laundry room and start a load of towels in the washer.

2) All dirty dishes, cookware and eating utensils should be placed in the dishwasher and the dishwasher ran upon departure.

3) Floors should be in generally good condition and ready to be vacuumed / swept by our housekeepers.

4) All household trash and garbage and/or other discarded items should be properly bagged up so as to avoid spillage/leakage, and deposited in the proper refuse containers provided outside. Homes are located in wooded settings where wildlife abounds – therefore, under NO circumstances should household refuse be deposited and/or otherwise left unsecured outside or additional charges may apply. All items need to be placed in the outside garbage bin and the garbage sign placed on “YES”. This alerts the garbage men that garbage service is needed,

5) Refrigerator and microwave should be left clean and free of food.

6) All appliances (stove, oven, BBQ, etc.) should be left in a clean condition and free of spills and grease.

7) All litter must be picked up from the premises and placed in the outside garbage cans, tied securely in trash bags.

8) Please try not to leave any pet hair to a minimum. (if property permits pets.)

9) GLITTER AND CONFETTI ARE NOT ALLOWED AT ANY PROPERTY, INSIDE OR OUTSIDE. DO NOT USE TAPE ON ANY PROPERTY SURFACE.

10) Cart(s) returned to charging area, placed on charge and garbage removed from the cart and placed in the garage cans. Also pick up any garbage left in the garage.

LINENS & TOWELS: Bath towels, sheets, pillows and blankets are provided. We do not provide any linens or towels for outdoor use. DO NOT take the property linens or towels outside. Bring items with you that you may need for sunbathing. One set of sheets / towel / wash cloth per guest are provided as well.

SMOKING: Smoking is NOT permitted in any BHI Turtle Time Vacations, LLC Property. Smoking is allowed outside as long as butts and ashes are not left behind. Discard the butts and ashes in the outside garbage. Do not throw butts on the ground or bring them into the rental. If there is any tobacco smell in the home after your departure, there will be a minimum of a $250.00 charge. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for excessive cleaning.

PLUMBING: Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain.

SATELLITE TV, INTERNET & PHONE CALLS: All properties are privately owned and have different subscription packages for cable and/or satellite and internet. BHI Turtle Time Vacations, LLC does not guarantee any programs, events or reception. Guest(s) are liable for ordering any Pay Per View – if Guest(s) does not use their own credit card for ordering, programming charges plus an additional $35.00 processing fee will be charged to the credit card we have on file. Some properties are equipped with a telephone; short calls within the U.S. are permitted.

WOOD STOVE/FIREPLACE: Fireplaces are not to be used per our insurance.

PETS: Pets are allowed as long as the applicable pet fees have been paid and the home is advertised as “Pet Friendly”. Unauthorized occupancy of pets will result in immediate eviction and loss of all rents and deposits. If discovery of unauthorized pets is made after your departure, a penalty of $100.00/day plus any additional cleaning charges will be assessed. If you are given permission to bring a pet the following rules must be followed:

1) $400.00 pet fee plus taxes

2) No pets on any furniture or bedding.

3) Please do your best to remove all pet hair to avoid additional cleaning time/charges.

4) All waste must be picked up and placed in the garbage cans tied securely in trash bags.

5) Pets should not be left unattended in home unless crated.

6) Damage up to $3000.00 or $5,000.00 (Depends on the home rented) caused by authorized pets is COVERED if you opted in for the Vacation Rental Damage plan!

Otherwise, guest assumes full responsibility for any damage caused by pet to be charged to credit card on file.

7) Any excessive cleaning that must be done will be charged to renter at rate of $100.00 an hour.

LOST OR FORGOTTEN ITEMS: Please check carefully for belongings before you leave. Items left behind can be mailed to you if requested and you will be charged shipping costs plus a $35.00 service fee. BHI Turtle Time Vacations, LLC is not responsible for lost or stolen items.

RIGHT OF ENTRY: Guest(s) agree that BHI Turtle Time Vacations, LLC reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate, or to show the property to prospective purchasers or guests (in which case prior notification will be given).

SECURITY & SAFETY RISKS: ALWAYS LOCK DOORS AND WINDOWS WHEN YOU LEAVE THE HOME! When you rent the home, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the home. Guest is responsible for lost key replacement costs. Children are welcome, but there are conditions in and around the home that may pose hazardous to them, as well as to adults. BHI Turtle Time Vacations, LLC does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard except emergency candles in case of power outage.

BICYCLE SAFETY- All bicycles at the Property are provided “as-is” by Owners, and no representations are made as to the condition of the bicycles, their features, or components, by BHI Turtle Time Vacations. Tenant should inspect bicycles prior to use and damaged or defective conditions should be reported to BHI Turtle Time Vacations. Tenant is responsible for all damage to the bicycles which occurs while this agreement is in effect as well as for any damage or injury caused by the use or misuse of the bicycles, regardless of who uses them. Tenant shall ensure that all users comply with the laws, ordinances and regulations of the State of North Carolina and the Village of Bald Head Island, including helmet and restraining seat requirements and “rules of the road”, and for seeing that the bicycles are operated in a safe, non-reckless manner, for their intended purpose (e.g., no horseplay, no racing, no exceeding rider capacity), understanding that the bicycles will be sharing the public roadways with motorized vehicles and pedestrians. Tenant is responsible for providing, and for using in accordance with the manufacturers’ instructions, any and all equipment necessary or desirable for the proper and legal utilization of the bicycles, including helmets, restraining seats, carriers, lights, warning bells or signals, and the like, and BHI Turtle Time Vacations and Owner shall have no liability, therefore. By signing this agreement, Tenant assumes full responsibility and liability for the use of any bicycles and agrees to indemnify and hold  BHI Turtle Time Vacations and Owner free and harmless from liability for any claims arising out of such use. Note: Please do not leave bicycles at other properties or in other locations or outdoors. Bicycles must be present at the Property after Tenant departure or Tenant may be responsible for any applicable retrieval fees or replacement costs.

FIREARMS AND FIREWORKS- The possession or display of a firearm and the possession or use of fireworks (including “sparklers”) on the Property are strictly prohibited. Violation of this provision by a Tenant or by a guest or invitee of Tenant shall be deemed a material breach of this agreement by Tenant, for which BHI Turtle Time Vacations may immediately terminate this agreement and recover possession of the Property.

HURRICANES: When hurricanes threaten the area, it is imperative that you adhere to the instructions of BHI Turtle Time Vacations and the local authorities. When a Hurricane WATCH is issued, you should begin preparations for possible evacuation. BHI Turtle Time Vacations will monitor the storm along with local authorities and the National Hurricane Center. When probability of a hit becomes likely, Brunswick County will issue a MANDATORY EVACUATION. EVACUATION IS REQUIRED WHENEVER A MANDATORY EVACUATION IS ISSUED BY BRUNSWICK COUNTY OFFICIALS. You should pack all belongings, including food, and evacuate immediately. Neither BHI Turtle Time Vacations nor the property owner will be responsible for any items you may leave behind. Prior to leaving the property, complete the ‘Hurricane Preparation Checklist’ which includes:

  • Tightly locking and securing ALL doors and windows
  • Bring all deck furniture inside and anything which may be blown
  • Set thermostats to OFF position
  • Shut off water to the home
  • Close all blinds, make sure door is locked behind you and screen door are tightly latched

During periods of evacuation, you may call BHI Turtle Time Vacations for frequent updates of the storm and important information. There will be NO REFUNDS OR CREDITS FOR HURRICANE EVACUATIONS. AGENCY AND COMPENSATION- Tenant acknowledges that the Property is owned by one or more persons or entities (“Owner”) not party to this agreement and that BHI Turtle Time Vacations, LLC has been authorized to act for and is, in fact, acting for the Owner of the Property, as the Owner’s compensated agent. Tenant further acknowledges that BHI Turtle Time Vacations receives compensation from Red Sky Insurance for the placement of the Damage Waiver and Travel Protection Insurance described herein.

OWNER DUTIES- Owner shall: Comply with all current applicable building and housing codes to the extent required by the operation of the codes unless the structure is exempt from a current building or housing code; Make all repairs and do whatever is reasonably necessary to put and keep the property in a fit and habitable condition; Keep all common areas of the property in safe condition; Maintain in good and safe working order and reasonable and promptly repair all electrical, plumbing, sanitary, heating, ventilation, and other facilities and major appliances supplied by him or her upon written notification from the Tenant that the repairs are needed; BHI Turtle Time Vacations reserves the right to provide Tenant with other reasonably comparable accommodations in lieu of the Owner making such repairs. Tenant shall comply with all obligations imposed on tenants by applicable building and housing codes; shall keep the Property occupied by Tenant and all plumbing fixtures in the Property or used by Tenant as clean and safe as conditions permit; shall cause no unsafe or unsanitary conditions in the common areas  Owner will provide operable smoke detectors. The Owner shall replace or repair the smoke detectors if the Owner is notified by the Tenant in writing that replacement or repair is needed. The Owner shall annually place new batteries in a battery-operated smoke detector, and the Tenant shall replace the batteries as needed during the tenancy. Failure of the Tenant to replace the batteries as needed shall not be considered negligence on the part of the Tenant or Owner.

OTHER DUTIES.-Owner agrees to provide the Premises to the guest(s) in a fit and habitable condition. If, at the time of occupancy, Owner cannot provide the Premises in a fit and habitable condition or reasonably cure same or substitute a reasonably comparable Premises in such condition, then Agent shall refund to guest(s) all payments made by Guest(s).

TRUST DEPOSITS– All payments made by Tenant will be deposited in an interest-bearing trust account at First Citizens Bank, 53 Chatham Downs Drive, Chapel Hill, NC; with all interest from said trust account accruing to Agent. Credit card or e-check payments may be processed by insured third parties who shall make commercially reasonable efforts to make ACH transfers to Agent’s designated North Carolina banking institutions within three (3) business days. An amount not to exceed 50% of the total rental rate may be disbursed to the Owner (or as the Owner directs) prior to occupancy. Fees owed to third parties to pay for goods, services or benefits procured for the benefit of the Tenant, as well as the administrative fee may be disbursed prior to occupancy.  All other funds remaining in the trust account will not be disbursed until: (a) commencement of the tenancy; (b) a material breach by the Tenant; (c) the money is refunded to the Tenant; or (d) the termination of the Owner’s interest in the Property.

TRANSFER OF PREMISES– (a) If the Owner voluntarily transfers the Property, Tenant has the right to enforce the Agreement against the grantee of the Property if Tenant’s occupancy under this Agreement is to end 180 days or less after the grantee’s interest in the Property is recorded. If Tenant’s occupancy is to end more than 180 days after such recordation, Tenant has no right to enforce the terms of this agreement unless the grantee agrees in writing to honor this agreement. If the grantee does not honor this agreement, Tenant is entitled to a refund of all advance rent paid by Tenant (and other fees owed to third parties not already lawfully disbursed). Within 20 days after transfer of the Property, unless Agent is to continue as grantee’s agent, the grantee or the grantee’s new agent is required to: (i) notify Tenant in writing of the transfer of the Property, the grantee’s name and address, and the date the grantee’s interest was recorded; and (ii) advise Tenant whether Tenant has the right to occupy the Property subject to the terms of this agreement or receive a refund of any payments made by Tenant. (b) Upon termination of the Owner’s interest in the Property, whether by sale, assignment, death, appointment of a receiver, or otherwise, the Owner, Agent, or any other agent of Owner is required to transfer all advance rent paid by Tenant (and other fees owed to third parties not already lawfully disbursed) to the Owner’s successor-in-interest within30 days, and notify Tenant by mail of such transfer and of the transferee’s name and address. The real estate broker may deduct from advance rents transferred to Owner’s successor-in-interest all commissions and fees earned by the real estate broker prior to the transfer. However, if Tenant’s occupancy under this agreement is to end more than 180 days after recordation of the interest of the Owner’s successor-in-interest in the Property, and the successor-in-interest has not agreed to honor this agreement, all advance rent paid by Tenant, less deductible fees permitted by NCGS 42A-16. must be transferred to Tenant within30 days.

DISPUTES-This Agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina, and shall be treated as though it were executed in the County of Brunswick, State of North Carolina. Any action relating to this Agreement shall be instituted and prosecuted only in the Brunswick County Superior Court, North Carolina. You specifically consent to such jurisdiction and to extraterritorial service of process. You shall be responsible for all legal fees and court costs incurred by Agent and Owner in the enforcement of their rights or Your obligations under this Agreement.

EXPEDITED EVICTION– A material breach of this Agreement by You, which, in the sole determination of the Owner or Agent, results in damage to the Premises, personal injury to You or others, a breach of the peace, a nuisance to others, or a violation of law or local code, shall be grounds for termination of Your tenancy. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Vacation Rental Act will apply. You may be evicted under such procedures if You: hold over in possession after Your tenancy has expired; commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Your tenancy; fail to pay rent as required by this Agreement, or (have obtained possession of the Premises by fraud or misrepresentation.

INDEMNIFICATION & HOLD HARMLESS: While BHI Turtle Time Vacations, LLC and its Property Owners strive to maintain Vacation Properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the Vacation Property structures and premises at their own risk. BHI Turtle Time Vacations, LLC and its Property Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances, (including grills and golf carts) furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. Guest is responsible for all damages. This includes loss of use for future reservations of the vacation rental property and golf carts until necessary repairs are made. BHI Turtle Time Vacations, LLC will insure all repair work is performed in a timely manner. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the Vacation Properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the Vacation Property and/or its contents. BHI Turtle Time Vacations, LLC and its Property Owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Vacation Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, pools, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s) and invitees hereby agree to forever hold-harmless and indemnify BHI Turtle Time Vacations, LLC and its Property Owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the property.

ENTIRE AGREEMENT- This Agreement is the entire agreement among the parties with respect to the subject matter hereof, and no representations or covenants, whether oral or written, have been made regarding the subject matter hereof except as provided herein. 

SEVERABILITY- Every provision of this Agreement is intended to be severable, and if any term or provision hereof shall be declared illegal, invalid, or in conflict with North Carolina Law or the purposes of this Agreement for any reason whatsoever, or if the enforcement of any provision shall be waived, the validity of the remainder of this Agreement shall not be affected thereby. 

TENANT HAS READ, ACKNOWLEDGES, AND ACCEPTS THE TERMS SET FORTH WITHIN THIS VACATION RENTAL AGREEMENT AND THE POLICIES INCORPORATED HEREIN INCLUDING PROVISIONS CONCERNING TRAVEL INSURANCE AND CANCELLATION. 

Should Tenant not understand any provisions herein, he should consult an attorney. BHI Turtle Time Vacations, LLC reserves the right to request a copy of Tenant’s active driver’s license as an additional provision of the Rental Terms & Conditions  as proof of age.
